I understand that electronic communication with Clarkson Eyecare physicians should NOT be used in the case of a need for emergency care and applies to all patients of Clarkson Eyecare and all Clarkson Eyecare offices and Physicians.
I understand that refusal to this consent for electronic communication will not affect my ability to obtain treatment from Clarkson Eyecare Physicians.
I hereby request electronic communication via email that contains a link to protected health information in my health record maintained or created by Clarkson Eyecare Physicians.
I understand that by providing an email address, I attest that I control access to its information. Additionally, I understand that when I transmit information via the Internet, my information will be transmitted over a medium that is beyond the control of Clarkson Eyecare, and therefore the security of the transmission may be compromised before it reaches Clarkson Eyecare.
I understand that by providing an email address and creating a Clarkson Eyecare Patient Portal, I am agreeing not to share my password with others where unwanted access may occur.
I understand that Clarkson Eyecare Physicians will not solicit my email address, account username or passwords for my account. ***These passwords are my sole responsibility for up-keep. If I forget my password, I will be required to know registration information, i.e. secret question(s) to continue. **
I understand that I may revoke this consent, in writing by providing the Clarkson Eyecare office with a verification of my identity and requesting that my current email address be removed from the system.
**This will not apply to communication that has been sent prior to the revocation date. **
The information authorized for release may also include drug/alcohol abuse treatment information. This category of medical information is protected by Federal Confidentially Rules (42 CFR Part 2).
The Federal rules prohibit anyone receiving this information from making further release unless further release is expressly permitted by the written authorization of the person to whom it pertains or as otherwise permitted by 42 CFR Part 2. A general authorization for the release of medical or other information is not sufficient for this purpose. The Federal rules restrict any use of the information to criminally investigate or prosecute any alcohol or drug abuse patient. As a result, by signing below I specifically authorize my information included in my health information to be released via electronic communication.
I understand the information authorized for release may include information which may indicate the presence of communication disease or non-communicable disease.
I understand that this service of electronic communication is offered solely on the discretion of Clarkson Eyecare Physicians and may be withdrawn at any time.
I understand this is not a request for release of my medical records.
ANY SERVICES, CONTENT OR INFORMATION CONTAINED OR PROVIDED BY Clarkson Eyecare ON THIS PORTAL IS PROVIDED ON AN "AS IS" BASIS. Clarkson Eyecare DOES NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS OR ENDORSEMENTS WHATSOEVER (INCLUDING WITHOUT LIMITATION WARRANTIES OF TITLE OR NONINFRINGEMENT, OR THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE) WITH REGARD TO THE SERVICE OR ANY MERCHANDISE, INFORMATION OR SERVICE PROVIDED THROUGH THE SERVICE. IN ADDITION, Clarkson Eyecare DOES NOT GUARANTEE THAT USE OF THE Clarkson Eyecare PATIENT PORTAL WILL BE FREE FROM TECHNOLOGICAL DIFFICULTIES INCLUDING, BUT NOT LIMITED TO, UNAVAILABLITY OF INFORMATION, DOWNTIME, SERVICE DISRUPTIONS, VIRUSES OR WORMS AND IT IS UNDERSTOOD THAT THE USER IS RESPONSIBLE FOR IMPLEMENTING SUFFICIENT PROCEDURES FOR ACCURACY OF DATA INPUT AND OUTPUT.
THE USE OF THE PATIENT PORTAL IS ENTIRELY AT THE RISK OF THE USER AND NEITHER Clarkson Eyecare NOR ANY OF ITS AFFILIATES, SUPPLIERS, AND OTHER THIRD PARTIES MENTIONED ON THIS SITE ARE NEITHER RESPONSIBLE NOR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES (INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOST INCOME, LOST DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATING IN ANY WAY TO THE SITE, SITE-RELATED SERVICES AND/OR ANY HYPERLINKED WEB SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. I agree that any dispute or claim (including personal injury claims) related to your use of the patient portal is subject to the exclusive jurisdiction of the appropriate court in the state in which my care was given on-site by Clarkson Eyecare.
